Most people think of their estate as consisting of real property, personal property and tangible property. However, an often forgotten aspect of the estate is digital assets. Digital assets include picture and video storage sites, email accounts, social networking sites, domain names, games and related sites, online sites, backup sites, and online banking accounts. Most individuals have numerous usernames, passwords, and security questions that are not easily available to estate administrators. Without being provided this information and the location of the information, your administrator may be burdened with dealing with significant hurdles or legal battles to gain access to such information.

10 Tips for a Successful Deposition

If you are a party to litigation whether the plaintiff or defendant, it is likely that your deposition will be taken at some point during the case.  A deposition provides the other party with an opportunity to ask questions and elicit information before a case goes to trial. Your testimony is given under oath and everything that is said is taken down by a court reporter.

New Jersey Law and Same Sex Marriage

Naturally, the community of matrimonial attorneys should be concerned with who can marry and in turn, who can divorce.  Exactly who has the right to marry, remains a hot topic and one of much controversy in New Jersey.   Initially, New Jersey was one of the first states to implement a domestic partnership scheme.  Then, on December 14, 2006, the New Jersey Legislature passed a bill providing for civil unions.  The Civil Union Act came into effect on February 19, 2007. Under the Civil Union Act, same-sex couples who enter into a civil union are provided almost all the rights granted to married couples under the New Jersey state law.  However, under the provisions of the federal Defense of Marriage Act, same-sex couples in marriages, civil unions or domestic partnerships do not have any right or entitlement to the 1,138 rights that a married couple has under federal law.
