Unless your loss is excluded by the language of the policy, there may be coverage under the policy you purchased notwithstanding an insurer’s denial. Furthermore, if you win, you may be able to recover your attorney’s fees under a special provision of the New Jersey Court Rules that allows insureds to recover attorney’s fees and costs of suit when they have to sue their insurer to obtain coverage, and prevail.
