If you have been approved for an ordinary disability pension, it may affect your workers’ compensation case. This will be true if the conditions listed in your disability pension are the same as in your workers’ comp claim.

The overlap of the times for your disability pension and your workers’ comp claim will result in an offset. Use information received from the Division of Pensions and Benefits to find the amount contributed by yourself and the employer over time, and then calculate the offset.

Note the specific retirement date on your pension application. If your workers’ compensation benefits ended before the retirement date, then that could constitute a gap during which you could receive workers’ comp without it being offset by the disability pension. Watch the video to learn more.
